Terms and Conditions
These Terms and Conditions ("Terms") govern your access to beforethebeep.com and the services provided by Pembroke Holdings LLC, doing business as Before the Beep ("Before the Beep," "we," "us," or "our"). By using the website or services, you agree to these Terms.
1. Eligibility and authority
You must be at least 18 years old to use the website or services. If you act for a company or other organization, you represent that you have authority to accept these Terms on its behalf.
2. Website information
The website provides general information about Before the Beep. We may update website content, plans, or availability. A service order, proposal, subscription confirmation, or other written agreement accepted by you (a "Service Order") will describe the services your business purchases. If a Service Order conflicts with these Terms, the Service Order controls for that conflict.
3. Services and plan features
Before the Beep provides phone-answering, caller intake, messaging, and related workflow services. Features depend on the selected plan and approved configuration. Missed-Call Backup captures and delivers caller information. Appointment booking, live transfers, automated follow-up, integrations, and other capabilities are available only when included in the applicable plan or Service Order and supported by the connected systems.
4. Pricing, billing, and cancellation
Current starting prices and included usage are shown on the website. Your Service Order will state your actual plan fee, setup fee, included usage, excess-usage rate, add-ons, and billing schedule. Plans are month to month unless a Service Order states otherwise. You authorize us and our payment provider to charge the payment method you provide for amounts due.
You may cancel according to your Service Order. Cancellation stops future renewal charges but does not erase amounts already due or charges for usage and work already provided.
5. 30-day plan-fee guarantee
If you cancel within 30 days after your paid service begins, we will refund your first monthly plan fee. Setup work, excess usage, custom add-ons, and other one-time charges are non-refundable. The guarantee applies once per customer unless we agree otherwise in writing.
6. Your responsibilities
You are responsible for:
- Providing accurate, current business information, service details, hours, instructions, and scheduling rules.
- Reviewing and approving your call path before launch and promptly telling us when information changes.
- Maintaining the phone, forwarding, calendar, CRM, and other accounts needed for your configuration.
- Using the services lawfully and obtaining any notices, permissions, and consents required for call recording, transcription, automated communications, data processing, and outreach.
- Following up on caller information and independently evaluating each job, customer, and service request.
- Protecting account credentials and notifying us promptly of suspected unauthorized use.
7. Important service limitations
The services rely on artificial intelligence, telephone networks, internet services, and third-party platforms. Calls may be interrupted, delayed, misrouted, inaccurately transcribed, or handled differently from what you expect. You must review the configuration and maintain a reasonable backup process for important communications.
Before the Beep is not an emergency-response service, dispatch center, medical service, or professional trade adviser. Do not configure or rely on the service as the only way to reach emergency assistance. Callers with an emergency should contact 911 or the appropriate local emergency service.
We do not guarantee leads, booked jobs, revenue, conversion rates, uninterrupted availability, or compatibility with every calendar, CRM, telephone carrier, or other platform.
8. Acceptable use
You may not use the website or services to violate law; harm, threaten, deceive, or impersonate another person; send unlawful spam or abusive communications; infringe intellectual-property or privacy rights; collect information without required notice or consent; probe or interfere with security; introduce malicious code; or resell or reverse engineer the services without written permission.
9. Intellectual property
Before the Beep and its licensors own the website, service software, branding, designs, and related materials. Subject to these Terms and your Service Order, we grant you a limited, non-exclusive, non-transferable right to use the services for your internal business operations during your paid subscription. You retain ownership of information and materials you provide to us. You give us permission to use those materials only as needed to provide, secure, and support the services and meet our legal obligations.
10. Third-party services
The services may connect to or depend on third-party platforms, including telephone carriers, AI providers, email services, calendars, CRMs, and payment systems. Their services and terms are outside our control. We are not responsible for a third party's availability, changes, or acts, but we will use reasonable efforts to support the connections included in your Service Order.
11. Privacy
Our Privacy Policy explains how we handle personal information. You agree to provide any privacy notice and obtain any permission required for information you direct us to process through the services.
12. Disclaimers
To the fullest extent permitted by law, the website and services are provided "as is" and "as available." Except for any express promise in a Service Order, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.
13. Limitation of liability
To the fullest extent permitted by law, Before the Beep, Pembroke Holdings LLC, and their owners, personnel, affiliates, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from the website or services. Any additional liability terms in an applicable Service Order control. Nothing in these Terms limits liability that cannot legally be limited.
14. Suspension and termination
We may suspend or terminate access if payment is overdue, use creates a security or legal risk, these Terms are materially violated, a required third-party service becomes unavailable, or suspension is reasonably necessary to protect callers, customers, or the service. When practical, we will provide notice and an opportunity to resolve the issue.
15. Governing law
Maryland law governs these Terms, without regard to conflict-of-law principles. Any dispute relating to these Terms or the website must be brought in a state or federal court located in Maryland, and each party consents to those courts' jurisdiction, unless an applicable Service Order provides a different dispute process.
16. Changes to these Terms
We may update these Terms as our services or legal obligations change. The updated Terms will be posted here with a revised effective date. Material changes will apply prospectively, and we will provide additional notice when required.
17. General terms
If a provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them in connection with a reorganization, financing, sale, or transfer of the business. These Terms, the Privacy Policy, and any Service Order form the entire agreement about their subject matter.
